1. Agreement
These Terms and Conditions ("Terms") form a legal agreement between you ("you", "your") and Trinitas Homes Pty Ltd (ABN 63 686 243 416), of Suite 329, 98–100 Elizabeth Street, Melbourne, VIC 3000, Australia ("Trinitas", "we", "us", "our") regarding your use of the Majella mobile application and any related services (together, the "App").
By downloading, installing, or using the App, you confirm you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the App.
2. Eligibility
The App is intended for users aged 13 and over. If you are under the age of majority in your country (generally 18), you must have a parent or guardian's permission to use the App and to agree to these Terms on your behalf.
The App is not directed at children under 13. If you become aware that someone under 13 is using the App, please contact us at admin@trinitashomes.com.au.
3. Purpose, scope, and important disclaimers
Read this section carefully. By using the App, you accept everything in it.
3.1 What Majella is
Majella is a cycle tracker and Natural Family Planning (NFP) charting tool. You enter observations about your cycle (period dates, mucus, basal body temperature, LH test results, symptoms, notes); Majella stores them, displays them on charts, and — in the Premium tier — generates predicted fertile and infertile windows based on established fertility awareness methods.
3.2 What Majella is NOT
Majella is not, and must not be treated as:

a medical device, registered or otherwise, in any jurisdiction
-
a contraceptive, contraceptive device, or method of birth control
-
a diagnostic, screening, or monitoring tool for any medical condition
-
a fertility treatment or assisted reproductive technology
-
a pregnancy test, ovulation test, or laboratory instrument
-
a sexual-health or sexually transmitted infection (STI) prevention tool
-
a substitute for a qualified, certified NFP instructor
-
a substitute for advice, diagnosis, or treatment from a licensed healthcare professional
-
a source of emergency medical guidance
-
a tool whose output should be relied upon as the sole basis for any reproductive decision
Nothing the App displays — including charts, predictions, tips, articles, glossary entries, phase indicators, or peak-day suggestions — constitutes medical advice.
3.3 No medical advice
The educational content within Majella (tips, articles, method guides, glossary) is general information only. It does not consider your individual medical history, conditions, medications, or circumstances. Always consult a licensed healthcare provider for medical advice, and a certified NFP instructor for method instruction.
We do not review, verify, or endorse the third-party resources linked from within the App (including NFP instructor directories, articles, and method guide websites). These resources are provided for your convenience. Their inclusion does not constitute medical advice or an endorsement of any particular method, instructor, or organisation.
3.4 NFP methods have a real failure rate
All natural family planning methods — including the Symptothermal Method, mucus-only methods, BBT-only methods, calendar methods, and LH-strip methods — have a non-zero failure rate for both pregnancy avoidance and conception, even when used correctly by experienced charters. Typical-use failure rates are substantially higher than perfect-use rates.
Calendar-only approaches (as offered in the Free tier) are the least reliable method of cycle estimation. They should not be used as a basis for reproductive decisions.
3.5 Predictions are estimates only
Predicted fertile windows, infertile windows, peak day suggestions, phase indicators, cycle analytics, insights, and any other prediction or output Majella displays are estimates based on the data you have entered. They are not:

guarantees of fertility or infertility on any given day
-
medical opinions or clinical assessments
-
validated, certified, or approved by any regulatory authority (including but not limited to the TGA, FDA, CE/UKCA, or any equivalent body)
Confidence varies with completeness and consistency of charting. Partial charting, missing observations, illness, travel, stress, sleep disruption, medication, and many other factors reduce reliability. Predictions can be wrong.
3.6 Automated decision-making
Majella uses algorithmic processing to generate cycle predictions, phase estimates, and insights based on the data you enter. This processing occurs entirely on your device. No human reviews or overrides the algorithm's output. You should always apply your own judgment — and where appropriate, the guidance of an NFP instructor or healthcare professional — before acting on any output.
3.7 Conditions and circumstances that affect reliability
Majella's predictions assume reasonably regular ovulation. They may be unreliable, misleading, or unsafe to rely on if you have or are experiencing — without limitation:

polycystic ovary syndrome (PCOS), endometriosis, thyroid disorders, hyperprolactinaemia, or other endocrine conditions
-
perimenopause or menopause
-
breastfeeding, postpartum, or post-miscarriage recovery
-
recent discontinuation of hormonal contraception
-
use of hormonal medications, fertility medications, or any drug that affects the menstrual cycle
-
significant weight change, eating disorder, intense athletic training, or chronic illness
-
irregular, anovulatory, or absent cycles for any reason
In these situations, do not rely on Majella's predictions. Work with a certified NFP instructor and your healthcare provider.
3.8 No protection from sexually transmitted infections
Majella offers no protection against HIV or any other sexually transmitted infection. If STI protection is relevant to you, use appropriate barrier methods and seek medical guidance.
3.9 Your data, your accuracy
Majella's output is only as accurate as the data you enter. Missed observations, mis-entered temperatures, mis-classified mucus observations, retroactive edits, time-zone changes, and incomplete cycles can all affect output. You are responsible for the accuracy and completeness of your data.
3.10 Your decisions, your responsibility
Any decision you make about — without limitation — conception, contraception, sexual activity, medication, medical procedures, lifestyle, or relationships, with or without reference to Majella, is your own decision and your own responsibility. You knowingly and voluntarily accept the risks of those decisions, including but not limited to:

becoming pregnant when trying to avoid pregnancy
-
not becoming pregnant when trying to conceive
-
miscarriage, ectopic pregnancy, or any other pregnancy outcome
-
delayed detection of a medical condition
-
emotional, psychological, relational, financial, or other consequences flowing from a decision informed by the App
3.11 Emergencies
If you experience a medical emergency — including severe pain, heavy bleeding, suspected ectopic pregnancy, signs of miscarriage, or any other urgent symptom — contact your local emergency services or a healthcare provider immediately. Do not rely on the App.
3.12 Acknowledgment
By installing or using Majella, you acknowledge that you have read, understood, and accepted clauses 3.1 to 3.11, and that you are using the App with full awareness of its limitations and the risks set out above. If you cannot accept these terms, do not use the App.
4. Free and Premium tiers
Free tier
The Free tier provides cycle logging and calendar-based cycle estimation. Calendar-based estimation is the least reliable of all natural family planning approaches. It is offered as a basic tracking convenience. Do not rely on the Free tier to avoid or achieve pregnancy.
Premium tier (subscription)
The Premium tier unlocks additional charting features, including fertility awareness method engines, fertility predictions, educational content, custom tracking, cycle analytics, and chart export. Premium features may include multiple modes suited to different user goals. The specific features available to Premium subscribers may change over time as we develop the App.
Predictions in the Premium tier are framed as estimates and reflect Majella's best calculation based on the data you enter. Confidence varies based on completeness of charting.
Subscription billing
Premium subscriptions are sold through the Apple App Store (iOS) or Google Play Store (Android). By subscribing:

You authorise the App Store or Play Store to charge your account at the price and frequency displayed at purchase.

Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date.

You can cancel any time through your App Store or Play Store account settings. Trinitas cannot cancel subscriptions on your behalf.

Renewal pricing may change with notice as permitted by the App Store / Play Store.

Free trial periods (if offered) convert to paid subscriptions automatically unless cancelled before the trial ends.
We use RevenueCat, a third-party subscription management service, to process and verify subscriptions. RevenueCat receives your subscription status and transaction identifiers from Apple or Google. RevenueCat does not receive your cycle data or any health information.
Refunds
Refunds are handled by Apple and Google under their respective store policies. Trinitas does not process refunds directly. Your statutory rights — for example under the Australian Consumer Law, the EU Consumer Rights Directive, or the UK Consumer Rights Act — are not affected by this clause.
5. Partner sharing
Majella may offer an optional feature that allows you to share selected cycle information with a partner ("Partner Sharing"). If and when this feature is available, the following terms apply:
5.1 Your responsibility
You choose to enable Partner Sharing, you select what information is shared, and you may revoke sharing at any time. You are solely responsible for the decision to share and for choosing an appropriate level of detail.
5.2 Your partner's responsibility
Any person who receives shared cycle information through Partner Sharing is responsible for their own decisions and actions based on that information. Shared information is subject to the same limitations, disclaimers, and caveats set out in Section 3 of these Terms.
5.3 No liability for partner decisions
Trinitas is not responsible or liable for any decision, action, or consequence arising from a partner viewing, interpreting, or acting on shared cycle information. This includes, without limitation:

reproductive decisions made by either you or your partner
-
misunderstandings or misinterpretation of shared data
-
emotional, relational, or psychological consequences
-
any action taken by a partner based on predicted fertile or infertile windows, phase information, or any other shared data
5.4 Data handling
Shared data is encrypted before transmission. We design our systems so that your cycle data remains private and protected. You can stop sharing at any time, and your partner's access is revoked immediately. See our Privacy Policy for further detail on how shared data is handled.
5.5 No guarantee of delivery or accuracy
We do not guarantee that shared data will be delivered to your partner in real time, without delay, or without error. Network issues, device issues, or service interruptions may affect Partner Sharing. Shared data is subject to the same accuracy limitations described in clause 3.9.
5.6 Partner's acceptance of terms
By accepting a Partner Sharing invitation, the receiving partner agrees to be bound by these Terms insofar as they relate to the use of shared information, including the disclaimers in Section 3, the limitation of liability in Section 10, and this Section 5.
6. Your data
Majella does not require a server-side account. Your cycle data is stored on your device and, optionally, in your personal iCloud (iOS) or Google Drive (Android). You are responsible for:

Keeping your device secure

Maintaining backups (via iCloud or Google Drive if you choose)

Protecting access to the App (we strongly recommend enabling the in-app PIN lock)
We cannot recover data lost from your device or cloud account. See our Privacy Policy for full detail.
7. Anonymous usage data
Majella collects anonymous data about how the App is used (such as which features are accessed and general interaction patterns). This data cannot identify you personally and is never linked to your cycle data. It is used solely to improve the App. See our Privacy Policy for full detail, including the third-party analytics service we use.
8. Licence to use the App
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to download and use the App on devices you own or control, for your personal, non-commercial use.
You must not:

Copy, modify, distribute, sell, or lease any part of the App

Reverse engineer, decompile, or attempt to extract the source code
-
Use the App in a way that violates any law or third-party right
-
Use the App to develop a competing product
-
Remove or alter any copyright, trademark, or proprietary notices

Circumvent the Free / Premium tier separation or any access controls
-
Use automated means (scrapers, bots) to interact with the App
-
Use the App to harass, defame, or harm any person
9. Intellectual property
The App, its code, design, content (including the rotating tips, educational articles, glossary, and graphics), and the Majella name and logo are owned by Trinitas Homes Pty Ltd or its licensors and are protected by copyright, trademark, and other laws. Nothing in these Terms transfers any intellectual property rights to you, except the limited licence in clause 8.
Your data — the cycle entries, observations, and notes you enter — remains yours. We do not claim any ownership of it. We do not receive a copy of it.
10. App Store and Play Store terms
If you downloaded the App from the Apple App Store, you also agree to Apple's standard Licensed Application End User Licence Agreement (EULA). In the event of a conflict, the Apple EULA prevails for App Store–specific matters. You acknowledge that:

These Terms are between you and Trinitas, not Apple.

Apple has no obligation to provide maintenance or support for the App.

In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price; Apple has no other warranty obligation.

Apple is a third-party beneficiary of these Terms and may enforce them against you.
If you downloaded the App from Google Play, your use is also subject to the Google Play Terms of Service.
11. Disclaimers
To the maximum extent permitted by law:

The App is provided "as is" and "as available", without warranties of any kind, express or implied.
-
We do not warrant that the App will be uninterrupted, error-free, accurate, complete, or secure.
-
We do not warrant that predictions, charts, insights, analytics, or educational content will achieve any particular result, including pregnancy prevention or conception.
-
We do not warrant compatibility with every device, operating system, or future OS update.
-
We do not warrant the accuracy, availability, or suitability of any third-party content, resource, or service linked from within the App.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)), the EU Consumer Rights Directive, the UK Consumer Rights Act 2015, or any other applicable consumer protection law.
Where a statutory guarantee applies and cannot be excluded, our liability for breach is limited (where permitted) to: (a) replacing the App or supplying it again; or (b) refunding the amount you paid for the affected subscription period.
12. Limitation of liability
To the maximum extent permitted by law:

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, loss of reputation, emotional distress, or loss arising from pregnancy, non-pregnancy, miscarriage, or any reproductive outcome.

We are not liable for any decision, action, or consequence arising from the use of Partner Sharing (see Section 5).
-
We are not liable for any loss or damage arising from your reliance on the App's predictions, insights, analytics, or educational content.

Our total aggregate liability to you for any claim arising out of or relating to the App or these Terms is limited to the greater of (a) the amount you paid Trinitas for the App in the 12 months preceding the claim, or (b) AUD $100.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
13. Indemnity
You agree to indemnify and hold harmless Trinitas, its directors, employees, and contractors from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

Your breach of these Terms

Your misuse of the App
-
Your violation of any law or third-party right
-
Reproductive decisions you make based on or related to the App
-
Any claim by a partner arising from Partner Sharing (see Section 5)
14. Law enforcement and data requests
Because your cycle data is stored on your device and in your personal cloud account — not on our servers — we do not have the ability to produce your cycle data in response to a subpoena, court order, or law enforcement request. We cannot hand over data we do not hold. See our Privacy Policy for full detail on where your data is stored.
15. Termination
You may stop using the App at any time by deleting it from your device. Premium subscriptions must be cancelled separately through the App Store or Play Store.
We may suspend or terminate your access to the App if you breach these Terms, misuse the App, or if we discontinue the App. We will give reasonable notice where practical.
Clauses that by their nature should survive termination — including 9 (IP), 11 (Disclaimers), 12 (Limitation of liability), 13 (Indemnity), 14 (Law enforcement), 16 (Governing law), and 17 (Disputes) — will survive.
16. Changes to these Terms
We may update these Terms as the App evolves. When we make material changes:

We will update the "Last updated" date at the top.

We will notify you in-app.

Your continued use of the App after the update constitutes acceptance of the new Terms.
If you do not agree to a change, your remedy is to stop using the App and cancel any active subscription.
17. Governing law
These Terms are governed by the laws of Victoria, Australia, without regard to conflict-of-laws principles.
If you are a consumer in the European Union, the United Kingdom, or another jurisdiction whose laws give you the protection of your local consumer law regardless of choice-of-law clauses, those protections still apply to you.
18. Disputes
Before starting any formal proceeding, please contact us at admin@trinitashomes.com.au so we can try to resolve the issue informally.
If we can't resolve it, disputes will be submitted to the non-exclusive jurisdiction of the courts of Victoria, Australia, except that you may also bring proceedings in the courts of your country of residence if required by local consumer law.
For EU and UK consumers: you may also use the EU Online Dispute Resolution platform (https://ec.europa.eu/consumers/odr) where applicable.
19. General
Entire agreement. These Terms and the Privacy Policy form the entire agreement between you and Trinitas regarding the App.
Severability. If any clause is unenforceable, the rest of the Terms remain in effect.
No waiver. Our failure to enforce a clause is not a waiver of that clause.
Assignment. You may not assign these Terms. We may assign them to an affiliate or to a successor in connection with a merger, acquisition, or sale.
Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
