Privacy Policy

Your privacy matters to us. Majella handles information about your cycle and your fertility, which is some of the most personal information there is, and we have built the app to respect that from the ground up. This policy explains what we collect, how we use it, how it is stored, and the choices and rights you have.

This policy applies to the Majella app and to our website. By using either of them, you agree to this policy. Please also read our Terms and Conditions, which this policy forms part of.

1. Who we are

Majella is owned and operated by Trinitas Homes Pty Ltd (ABN 63 686 243 416), a company registered in Australia. In this policy, "we", "us" and "our" refer to Trinitas Homes Pty Ltd, and "you" and "your" refer to you, the person using Majella or our website.

2. Our approach in short

Majella is built to keep your information with you. The cycle and health information you record is stored on your own device. If you choose to turn on backup or sync, that information is kept in your own private cloud account provided by your device platform, not on servers that we run, and we describe exactly what that means in section 6.

We do not sell your personal information. We do not use it for advertising, and we do not allow others to use it for advertising. We collect the smallest amount of information we reasonably can.

We use a small amount of analytics to understand how the app and website are used so we can improve them. We have set this up so that it does not capture the cycle and health information you record, and section 3 explains it in more detail.

3. The information we collect

Information you record in the app. This includes the cycle and fertility information you enter, such as period dates, temperature readings, mucus and other observations, intercourse, symptoms, moods, notes, and the settings and preferences you choose. It can also include details you add to your profile, such as your name or the name and email address of a fertility awareness instructor if you choose to enter one.

This information is treated as sensitive information under Australian and other applicable privacy laws, and we handle it with extra care as described below. Most of it stays on your device and is not sent to us.

Subscription information. If you subscribe to Majella Pro, the purchase is made and managed through the Apple App Store or Google Play Store. We do not see or store your payment card details. We use a subscription management provider, RevenueCat, to confirm your subscription status. For this purpose a randomly generated identifier and your subscription and entitlement status are processed, but this is not linked by us to your name or to your health information.

Information when you contact us. If you email us or otherwise get in touch, we receive the information you choose to share, such as your email address and the contents of your message, so that we can respond.

Information when you share with an instructor. If you use the feature that lets you send a copy of your chart to a fertility awareness instructor, that information is sent from your device to the email address you enter. You control when this happens and who receives it.

Information collected through our website. If you join our waitlist, we collect the email address you provide so that we can let you know about availability and updates. Our website is built and hosted on Wix. Wix and our analytics provider process limited technical and usage information, such as your IP address, device and browser details, the pages you visit and how you interact with the site, both to keep the site running securely and to help us understand how it is used. Our website uses cookies and similar technologies for these purposes. We do not use them for third party advertising.

4. How we use your information

We use the information described above to provide the app and its features to you, to calculate the estimates and charts that the app shows you, to manage your subscription, to respond to you when you get in touch, to keep our app and website secure and working, to let waitlist subscribers know about availability, and to meet our legal obligations.

We do not use your health or cycle information for any purpose other than providing the app to you on your device, and we do not receive it unless you choose to send it to us, for example by contacting support.

5. Legal bases for using your information

Where the law that applies to you requires a legal basis for using your information, we rely on the following. We process your health and cycle information on the basis of your explicit consent, which you can withdraw at any time by stopping your use of those features or by deleting the app. We process subscription and contact information because it is necessary to provide the app to you and to respond to your requests, and we process limited technical information on the basis of our legitimate interests in keeping the app and website secure, balanced against your rights.

Where you have given consent, you can withdraw it at any time, and doing so does not affect anything we did before you withdrew it.

6. How your information is stored and protected

This section describes how your most sensitive information is kept. Please read it carefully.

The cycle and health information you record is stored on your device. If you choose to enable backup or sync, that information is stored in your own private cloud account provided by your device platform, for example your private iCloud account on Apple devices. That account belongs to you, not to us. Your device platform encrypts this information in transit and at rest under its own security arrangements, which are governed by that provider's terms and privacy policy.

We do not run any servers of our own, and your information is not sent to us when you use the app. Because your backup lives in your own private cloud account rather than in any system we control, we cannot access its contents. Where your device platform offers additional encryption protections for that account, such as Apple's Advanced Data Protection, those are managed by you and your platform, not by us.

You can also protect access to the app on your device using the app lock feature, which is stored securely on your device.

No method of storage or transmission is completely secure, and while we take reasonable steps to protect your information we cannot guarantee absolute security.

7. Who we share information with

We do not sell your personal information, and we do not share it for anyone's advertising.

We share limited information only with service providers who help us run the app and website, and only so they can perform that service for us. These include the Apple App Store and Google Play Store and our subscription management provider for handling subscriptions, our product analytics provider for understanding usage, and Wix for building and hosting our website. These providers act on our instructions and are not permitted to use your information for their own purposes.

We may disclose information if we are required to by law, by a court order or by a valid request from an authority, or where we reasonably need to in order to protect our legal rights or the safety of others. Because your health and cycle information is generally held on your own device and in your own private cloud account rather than by us, a request of this kind to us would generally not give access to that information.

8. International transfers

We are based in Australia. Some of our service providers may store or process information in other countries. Where information is transferred across borders, we take reasonable steps to ensure it is handled in line with this policy and with applicable law, including by relying on recognised safeguards such as standard contractual clauses where they are required.

9. How long we keep information

The cycle and health information you record stays on your device and in your own cloud account for as long as you keep it there. You can delete it at any time, and you can remove all of it by deleting the app and clearing the relevant data from your cloud account.

We keep subscription records and contact correspondence only for as long as we need them for the purposes described in this policy and to meet our legal, accounting and record keeping obligations, after which we delete or anonymise them. We keep waitlist email addresses until you ask us to remove them or until they are no longer needed.

10. Your rights

Depending on where you live, you have rights over your personal information. These can include the right to access the information we hold about you, to ask us to correct it if it is wrong, to ask us to delete it, to object to or restrict certain uses, to withdraw consent, and to receive a copy of certain information in a portable form.

Because most of your health and cycle information is held on your own device and in your own cloud account rather than by us, you can view, change and delete most of it directly within the app at any time, which is often the quickest way to exercise these rights.

To make a request about information we hold, contact us at admin@trinitashomes.com.au. We will respond within the time required by law. We will not charge you for making a request except where the law allows, and we will not treat you differently for exercising your rights.

If you are in California, you have rights under the California Consumer Privacy Act, including the right to know, to delete, and to opt out of any sale or sharing of your personal information. We do not sell or share your personal information as those terms are defined under that law.

Depending on where you live, you may also have the right to lodge a complaint with your local privacy or data protection authority if you are not satisfied with how we have handled your information.

11. Children

Majella is not directed at children. You must meet the minimum age set out in our Terms and Conditions to use the app, and we do not knowingly collect information from anyone below that age. If you believe a child has provided us with information, please contact us so we can address it.

12. Changes to this policy

We may update this policy from time to time, for example to reflect changes to the app, to our practices or to the law. When we do, we will update the date at the top of this page, and where the changes are significant we will take reasonable steps to let you know. Your continued use of Majella after the changes take effect means you accept the updated policy.
