Terms & Conditions

Please read these Terms and Conditions carefully before using Majella. They form a legal agreement between you and us, and by downloading, accessing or using the app you agree to be bound by them. If you do not agree, please do not use Majella.

1. Who we are

Majella is owned and operated by Trinitas Homes Pty Ltd (ABN 63 686 243 416), a company registered in Australia. In these terms, "we", "us" and "our" refer to Trinitas Homes Pty Ltd, and "you" and "your" refer to you, the person using the app.

2. Please read this first: health and medical disclaimer

This is the most important section of these terms.

Majella is a fertility awareness and cycle tracking tool. It is designed to help you record your own observations and to present them back to you in a clear way. It is intended for general informational and educational purposes only.

Majella is not a medical device, is not a form of contraception, and does not provide medical advice, diagnosis or treatment. It is not a substitute for advice from a qualified healthcare professional or a certified fertility awareness instructor.

Fertility awareness based methods have inherent limitations. Their effectiveness depends on correct and consistent use, on the quality and regularity of the observations you record, and on factors that are unique to your body and circumstances. No method of fertility awareness is fully reliable for avoiding or achieving pregnancy, and Majella does not guarantee any particular outcome.

Predictions, fertile window estimates, phase labels and other information shown in the app are estimates based on the data you enter. They may be incomplete, delayed or wrong, and they should never be relied on as the sole basis for any decision about your health, contraception, conception or wellbeing.

You should always seek the advice of a qualified healthcare professional with any questions you have about your health, your cycle, your fertility or any medical condition. Never disregard professional medical advice or delay seeking it because of something you have read or seen in Majella. If you think you may have a medical emergency, contact your doctor or local emergency services immediately.

By using Majella you acknowledge that you understand and accept these limitations, and that you use the app and act on its information at your own discretion and risk.

3. Eligibility

To use Majella you must be at least 9 years old, or the age of digital consent in your country if that age is higher, and you must have the legal capacity to enter into these terms. If you are under the age required to consent to the processing of personal information in your country, you may only use the app with the involvement and consent of a parent or guardian.

By using Majella you confirm that you meet these requirements.

4. Your licence to use Majella

We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to download and use Majella on a device that you own or control, for your own personal and non-commercial use, subject to these terms and to the rules of the app store you downloaded it from.

You agree not to copy, modify, distribute, sell, lease, reverse engineer or attempt to extract the source code of the app, except to the extent that the law expressly permits this despite this restriction.

5. App store terms

You download Majella through the Apple App Store or the Google Play Store, and your use of the app is also subject to the terms of the store you used.

Where you obtain Majella through the Apple App Store, you acknowledge that these terms are between you and us only, not with Apple, and that Apple is not responsible for the app or its content. Apple has no obligation to provide support or maintenance for the app. You acknowledge that Apple and its subsidiaries are third party beneficiaries of these terms and may enforce them against you. You confirm that you are not located in a country subject to a relevant government embargo and that you are not on any relevant prohibited or restricted party list.

Where you obtain Majella through the Google Play Store, your use is also subject to the Google Play Terms of Service.

6. Subscriptions and payments

Majella offers a free tier and an optional paid subscription, Majella Pro, which unlocks additional features.

Subscriptions are sold and billed through the Apple App Store or the Google Play Store, not directly by us. The current price, billing period and any free trial are shown to you at the point of purchase before you confirm, and prices may vary by country and may change over time.

Where a free trial is offered, your subscription will automatically convert to a paid subscription at the end of the trial unless you cancel before the trial ends.

Subscriptions renew automatically at the end of each billing period at the then current price, and your chosen payment method will be charged, unless you turn off automatic renewal at least 24 hours before the end of the current period. You can manage and cancel your subscription at any time through your Apple or Google account settings. Cancelling stops future renewals but does not end the current paid period, which continues until it expires.

Payments, refunds and billing disputes are handled by Apple or Google under their own terms. We do not process your payment details and generally cannot issue refunds directly. If you believe you are entitled to a refund, please contact the relevant app store. This does not limit any rights you have under the Australian Consumer Law or other laws that cannot be excluded.

7. Your data and privacy

Your privacy matters to us, and how we handle your information is set out in our Privacy Policy, which forms part of these terms. Please read it to understand what we collect and how it is used.

You are responsible for the accuracy of the information you enter, and for keeping any device passcode, account login or app lock secure. Majella stores much of your data on your device and, where you choose, in your own cloud account. You are responsible for maintaining your own backups, and we are not responsible for data that is lost, including where it is lost because of device failure, deletion, or changes to your device or cloud settings.

8. Acceptable use

You agree to use Majella only for lawful purposes and in line with these terms. You agree not to use the app in any way that breaks the law, infringes the rights of others, interferes with or disrupts the app or its security, or attempts to gain unauthorised access to our systems or to other users' information.

9. Intellectual property

Majella, including its name, logo, design, text, graphics, software and all other content we provide, is owned by us or our licensors and is protected by intellectual property laws. Nothing in these terms transfers any of those rights to you, other than the limited licence to use the app described above.

The educational content in the app is provided for general information only and remains our property or that of our licensors.

10. Third party services and links

Majella may rely on or link to services provided by others, such as the app stores, payment and subscription providers, cloud storage, and external websites or instructor directories. We do not control those services and are not responsible for their content, availability or practices. Your use of them is subject to their own terms.

11. Availability and changes to the app

We work hard to keep Majella available and working well, but we do not promise that it will always be available, uninterrupted or free of errors. We may update, change, suspend or withdraw the app or any of its features at any time, including for maintenance, security or to comply with the law.

12. Disclaimers

To the maximum extent permitted by law, and subject to section 13 below, Majella is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that the app, or any prediction, estimate or other information it provides, is accurate, complete, reliable or fit for any particular purpose.

13. Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.

Where our goods or services come with guarantees that cannot be excluded under the Australian Consumer Law, and where it is fair and reasonable to do so, our liability for failing to meet one of those guarantees is limited, at our option, to supplying the services again or paying the cost of having them supplied again.

14. Limitation of liability

Subject to section 13, and to the maximum extent permitted by law, we are not liable to you for any indirect, incidental, special or consequential loss, or for any loss of profit, data, or anticipated savings, arising out of or in connection with your use of, or inability to use, Majella.

In particular, and again subject to section 13, we are not liable for any decision you make, or any outcome you experience, in connection with conception, the avoidance of pregnancy, your health or your wellbeing, where you have relied on the app or the information it provides. Please re-read section 2.

To the maximum extent permitted by law, and subject to section 13, our total liability to you in connection with the app and these terms is limited to the amount you paid us for the app in the twelve months before the event giving rise to the liability.

15. Indemnity

To the extent permitted by law, you agree to indemnify us against any claims, losses, liabilities and reasonable costs arising from your breach of these terms or your misuse of the app, except to the extent the loss was caused by us.

16. Suspension and termination

You may stop using Majella at any time by deleting it from your device. We may suspend or end your access to the app or to paid features if you breach these terms, if we reasonably need to in order to protect the app or other users, or if we stop offering the app. Sections that by their nature should survive termination, including the health disclaimer, intellectual property, disclaimers, limitation of liability and governing law, will continue to apply.

17. Changes to these terms

We may update these terms from time to time, for example to reflect changes to the app, to our practices or to the law. When we do, we will update the date at the top of this page, and where the changes are significant we will take reasonable steps to let you know. Your continued use of Majella after the changes take effect means you accept the updated terms.

18. Governing law

These terms are governed by the laws of Victoria, Australia. You and we agree to submit to the non-exclusive jurisdiction of the courts of Victoria, while preserving any right you have to bring proceedings in your own country of residence where the law requires.
